Terms of service.
1. Introduction
These Terms of Service ("Terms") govern your use of the services provided by Serene Solutions Therapy PLLC (“we,” “us,” or “our”) through our website and any related services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, you may not use the services.
2. Mental Health Services
We provide mental health counseling and wellness services in accordance with the licensing regulations in the State of Texas. Services offered include individual therapy, and other related mental health services. These services are provided by licensed mental health professional in compliance with Texas law.
3. No Emergency or Crisis Services
Our services are not intended for emergency situations. If you are in crisis, experiencing suicidal thoughts, or need immediate assistance, please call 911 or contact a crisis helpline such as the National Suicide Prevention Lifeline at 988. Do not use our services to attempt to access emergency care.
4. No Medical or Psychiatric Diagnosis
Our services do not include the diagnosis or treatment of medical or psychiatric conditions. We provide therapeutic services aimed at emotional and psychological well-being. However, diagnosis and treatment of psychiatric conditions, including the prescription of medications, must be conducted by a licensed medical or psychiatric professional. We will refer clients to appropriate resources when such services are needed.
5. Client Responsibilities
Clients are expected to provide accurate information and participate in sessions in good faith. Therapy is a collaborative process, and progress depends on the client’s active participation. Clients must also notify their therapist of any changes in mental or physical health that may impact treatment.
6. Appointment Scheduling and Cancellations
Clients can schedule appointments online or by phone. We require 24-hour notice for cancellations. Failure to provide appropriate notice may result in a cancellation fee. Continued failure to attend sessions without proper notice may lead to the termination of services.
7. Payment and Fees
Fees for services are determined at the time of booking. Payment is due at the time of service, unless otherwise agreed upon. We accept payment through credit card pay. We at this time do not accept insurance and are private pay only.
8. Confidentiality
We are committed to maintaining the confidentiality of all communications and records relating to treatment, in compliance with the Texas Health and Safety Code and HIPAA (Health Insurance Portability and Accountability Act). However, there are exceptions where we may be required by law to disclose information, including:
If there is reason to believe the client may harm themselves or others.
If there is suspicion of abuse or neglect of a child, elderly person, or disabled individual.
If records are subpoenaed by a court of law.
9. Telehealth Services
We offer telehealth services as an alternative to in-person therapy, in compliance with Texas law. Telehealth may include video conferencing or phone sessions. Clients using telehealth services must ensure they are in a private, safe, and appropriate location for the session. Both client and therapist are responsible for maintaining confidentiality during telehealth sessions. Clients must be physically present in the state of Texas at the time of their telehealth sessions.
10. Termination of Services
Either the client or the therapist may terminate the therapeutic relationship at any time. If you or the therapist believe that progress is not being made or if the services no longer meet your needs, a referral to another therapist or service may be recommended. Failure to comply with these Terms or to engage in the therapeutic process may result in the termination of services.
11. Minors and Parental Consent
For clients who are minors, services will only be provided with parental or guardian consent in accordance with Texas law. Parents or guardians may be involved in the therapy process, depending on the nature of the therapy and the client’s needs.
12. Texas-Specific Compliance
This practice operates in compliance with the regulations and guidelines established by the Texas Behavioral Health Executive Council and other relevant state authorities. All services provided comply with the laws of the State of Texas regarding licensing, professional conduct, and client confidentiality.
13. Limitation of Liability
While we are committed to providing high-quality mental health services, we make no guarantees or warranties regarding outcomes of therapy. By using our services, you agree that we are not liable for any direct, indirect, incidental, or consequential damages resulting from your use of the services, except where prohibited by law.
14. Governing Law
These Terms of Service are governed by the laws of the State of Texas. Any disputes arising out of or relating to these Terms or the services provided will be resolved in the courts of Texas.
15. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Clients will be notified of any significant changes. Your continued use of the services following any modifications indicates acceptance of the updated Terms.
